General Conditions of Sale – Wild Bed SAS.
PREAMBLE
These conditions govern the contractual relations relating to the sale of individual stays between the company WILD DEB SASU and its customers, in campsites managed by WILD BED, in accordance with the provisions of articles L. 211-1 et seq. of the Tourism Code.
They regulate all the steps necessary for making the reservation and payment for stays, and regulate all their follow-up between the contracting parties.
Any document other than these general conditions of sale and in particular prospectuses, advertisements, catalogs, has only informative and indicative value.
Definitions
“WEBSITE” means the website https://www.wildbed.fr, published by the company Wild Bed SAS.
“WILD BED” refers to campsites managed by Wild Bed SASU.
“RENTAL” means the rental contract for pitches or rentals in WILD BED campsites.
“PITCH” means a bare pitch where the customer sets up his own camping equipment (tent, caravan, motorhome, roof tent, etc.).
“RENTAL” designates all types of accommodation (chalets, lodges, mobile homes, tents, caravans, etc.) offered for rental by WILD BED.
“STAYS” means a rental accompanied by additional services which are defined in the special conditions.
“CUSTOMER” means any person reserving on the website, via the reservation center or directly with a campsite or a site whose contact details appear below in order to reserve, order and/or purchase any services offered by WILD BED
Entirety
These general conditions express the entirety of the obligations of the parties. In this sense, the CUSTOMER is deemed to accept them without reservation and in accordance with the provisions of article 1126 of the Civil Code.
These general conditions of rental and reservation of stays in a Wild Bed campsite apply to the exclusion of all other conditions.
They are accessible on the website www.wildbed.fr or www.camping-malicorne.fr and will prevail, where applicable, over any other version or any other contradictory document.
WILD BED and the CUSTOMER agree that these general conditions exclusively govern their relationship. WILD BED reserves the right to modify its general conditions from time to time. They will be applicable as soon as they are put online.
If a rental or stay reservation condition were to be missing, it would be considered to be governed by the practices in force in the sector of rental of campsites and stays in sites where the company has its headquarters in France.
Object
The purpose of these general conditions is to define the rights and obligations of the parties in the context of the rental of campsites, rental accommodation or stays offered on its various campsites and sites by WILD BED to the customer, from from the website www.wildbed.fr or www.camping-malicorne.fr but also by telephone from its sites, by email, from social network messaging services or by post.
Pre-contractual information The CUSTOMER acknowledges having been informed, prior to his reservation, of these general conditions of sale, rental and stays, and of all the information listed in article L. 111-1 of the Consumer Code.
The customer has all the information online or can have the services explained to them by staff on site, by telephone or electronically.
SERVICES AND PRICES
1) IN WILD BED CAMPSITES:
Rental of campsites:
WILD BED provides the customer with a bare pitch, which can accommodate up to 6 people, for their own camping equipment (tent, caravan or motorhome, etc.). Depending on the campsites, WILD BED offers different types of pitches, the descriptions of which are presented on the website.
The price of the pitch: This is a fixed price per night of occupancy for the type of pitch concerned. The basic package includes an installation, 1 or 2 people and a vehicle. Additional people (adults or children) or additional elements present on the pitch (second vehicle, electrical connection, animal, tent or additional shed, etc.) are subject to an additional daily cost. Rental seasons, rental periods and pricing periods are listed on the website.
The basic package gives free access to the health and reception facilities, the swimming pool (if applicable and on opening dates & times), the play areas and the activities offered free or for a fee.
For security reasons, the number of people arriving to stay cannot exceed the capacity of the campsite (6 people maximum).
Pitches are available from 3 p.m. on the day of arrival and must be vacated before 12 p.m. on the day of departure.
Rental of rental accommodation:
The description, definition of rental seasons, rental durations and pricing periods appear on the website.
The price of renting accommodation includes the rental of the accommodation, depending on the number of people (depending on capacity), charges (water, gas, electricity), a vehicle, access to reception services, the swimming pool (if applicable and on opening dates & times), the play areas, other equipment and the activities offered (free or paid).
For security reasons, the number of people arriving for a stay cannot exceed the capacity of the accommodation.
Equipped accommodation must be restored and clean upon departure. The rentals are all non-smoking.
Rentals are available from 3 p.m. on the day of arrival and must be vacated before 12 p.m. on the day of departure, except for occasional promotions detailed in our commercial brochures and the website www.wildbed.fr or www.camping-malicorne.fr .
Some campsites can, on weekends, outside school holidays, accept either an arrival the day before until 10 p.m., or a departure until 5 p.m. instead of 12 p.m. (with supplement). The CUSTOMER must, however, specify when booking or upon arrival that they wish to leave at 5 p.m. and pay the additional charge. The campsite may refuse if the accommodation or pitch is occupied the same evening.
Transfer, subletting: All rentals are nominative and cannot under any circumstances be transferred or sublet.
EVOLUTION OF PRICES
Prices are dynamic and can change as the season progresses. WILD BED cannot under any circumstances be held responsible for a difference in cost between two stays booked for the same period.
The prices indicated on the site are in euros, VAT included at the rate in force at the time of receipt of the deposit and the entire price. Any change or modification of rates as well as any evolution of the taxes applicable to the stay, on the billing date, may be reflected in the price of the stay.
TOURIST TAX
The tourist tax collected on behalf of municipalities or communities and to be paid by the CUSTOMER is generally not included in our prices. Its amount is determined per person and per day. It is decided by the community and varies depending on the destinations, the ages of the people and could be modified during the year.
PROMOTIONS and DISCOUNTS
Promotional offers are subject to certain conditions and in particular availability. Furthermore, price reductions or promotional operations cannot be combined with each other unless otherwise stated.
On these occasions, it is possible that for the same stay, customers paid different prices. Customers who have paid the highest price will under no circumstances be able to benefit from a refund of the difference between the price they paid and the promotional price.
A discount will be made for customers making “long” stays on bare pitches: -10% for stays of more than 14 days, -20% for stays of more than 20 days and -30% for stays of more of 30 days.
RESERVATION AND PAYMENT RESERVATION CONDITIONS The customer has the option of making their reservation online, by telephone, by email or by post, based on the presentation of the pitches, accommodation and services offered on the site www.wildbed.fr or www.camping-malicorne. Fr All reservations must be accompanied by a payment including: - A deposit, determined according to the chosen rate and depending on the reservation date. This deposit will be between 30% and 100% of the total amount of the stay (rental only or rental with services). - Any administration/reservation fees (see price list) and subscription to cancellation-interruption of stay insurance. Please note that for stays of 1 to 7 nights in a campsite, the deposit requested is 100% of the amount of the stay upon the customer's arrival. Whatever the channel chosen, the reservation becomes effective only after sending the written confirmation of reservation by Wild Bed by email (and on request, by post) and, after collection of the amount due of the deposit, and any costs file and subscription to cancellation insurance.
RESERVATION ON WEBSITE Concerning online reservations, for the order to be validated, the customer must accept, by clicking in the place indicated, these general conditions and validate their payment. Following their reservation, the customer will receive an email confirmation containing the details of their stay (content of services, dates and duration, price and payment terms). Electronic signature applicable to online sales the online provision of the customer's bank card number and the final validation of the order will constitute proof of the customer's agreement: - payment of sums due for the reservation, - signature and express acceptance of all operations carried out. In the event of fraudulent use of their bank card, the buyer is invited, as soon as this use is noticed, to contact the site where they reserved their stay.
TERMS OF PAYMENT In Wild Bed campsites: The full price of the stay is payable:
- 30 days before the start of the stay
- Or immediately for any reservation made less than 30 days from the start of the stay Payment for stay in bare pitch: the balance of the stay must be paid the day before departure or the day of arrival, depending on the campsite. Rental stay regulations: The balance of the stay must be paid, without reminder from WILD BED, 30 days before the arrival date planned for the rental or on arrival at the campsite when the customer has not reserved. In the absence of full payment on the agreed date, WILD BED is entitled to consider that the customer has canceled his reservation and retains the amounts already paid.
RIGHT TO RETRACT According to article L. 221-28 12° of the Consumer Code, the right of withdrawal is not applicable to accommodation, transport, catering and leisure services provided on a specific date or at a specific frequency.
PAYMENT METHODS When booking, payment of the deposit or the entire stay is made by bank card (the cards accepted are those of the Carte Bleue, Visa, Eurocard/Mastercard networks) or by the online payment methods offered on the wildbed.fr site or www.camping-malicorne.fr (STRIPE: IDEAL, SOFORT, BANCONTACT, GIROPAY; Floa in 4 x, ANCV holiday checks, bank check). The transaction is immediately debited from the customer's bank card after verification of the card's data. In accordance with article L.132-2 of the Monetary and Financial Code, the commitment to pay given by means of a payment card is irrevocable. By providing information relating to their bank card, the customer authorizes WILD BED to debit their bank card for the amount of the deposit or the entire stay. To this end, the customer confirms that he is the holder of the bank card to be debited and that the name appearing on his bank card is indeed his own. Payment of the balance of the stay can be made by credit card, the online payment methods offered on the wildbed.fr website (STRIPE: IDEAL, SOFORT, BANCONTACT, GIROPAY, bank check), in cash in euros, by holiday vouchers ( sent by registered mail with acknowledgment of receipt), by transfer to the Wild Bed bank account held at the Caisse d'Epargne de Normandie (IBAN FR76 1142 5002 0008 0017 6774 927 BIC CEPAFRPP142) and by check in euros up to 30 days before the arrival at the campsite. Bank checks are not accepted on the campsite.

Our financial partner FLOA offers payment solutions for your purchases of goods and/or services, in 3 or 4 installments by bank card. These payment solutions are reserved for individuals (major individuals) residing in France, holders of a Visa or MasterCard bank card with a validity date corresponding to the duration of the reimbursement. ASSIGNMENT OF PITCHES / ACCOMMODATION The allocation of places (camping or rental pitches) in a WILD BED campsite is carried out without distinction in the order of registration of reservations. Management cannot under any circumstances guarantee that the location or rental requested by the CUSTOMER will be allocated to them unless the latter chooses the “preferred location” option when booking. If the accommodation/location of their choice is available, it will be assigned to them and, in return, they will have to pay a flat rate of €10. However, in the event of force majeure, WILD BED reserves the right to modify the allocation of the pitch or rental.
MODIFICATION OF STAY A request for modification of services planned for the stay by the customer may be made up to 10 days before arrival. In this case, WILD BED will make every effort to accommodate this request depending on availability, if the chosen rate accepts the modifications. This modification request is subject to the collection of a flat rate of €30 for each rental and/or each pitch. In the event that WILD BED is obliged to modify the services initially planned for the stay, it will make every effort to provide similar services. If it is impossible to provide the equivalent service, the customer must refer to the “cancellation and refund” section.
CANCELLATION AND INTERRUPTION INSURANCE Wild Bed SASU offers optional cancellation and interruption of stay insurance distributed by MEETCH. This insurance covers in particular cancellations of stay in the event of illness (hospitalization), serious accident or death, disasters resulting in significant damage to your home, dismissal or modification of your leave due to the employer, following a summons to an examination or in court. The specific conditions of this contract are accessible when subscribing or on request by email. When booking online or by telephone/mail, the customer has the option of taking out the cancellation insurance offered by WILD BED SASU. Its amount is a percentage of the total amount of the stay.
CANCELLATION OF STAY Cancellation by WILD BED: the sums paid will be refunded in full.
Cancellation by the customer:
• The customer has subscribed to MEETCH cancellation insurance: the customer contacts the Meetch service provider directly and is reimbursed for their stay according to the conditions specific to this contract.
• The customer has not subscribed to MEETCH cancellation insurance and the special conditions below apply: Cancellation (total or partial) by the customer: the customer must notify WILD BED either by sending a letter to the following address: WILD BED SAS, Customer Service, 1 rue aux Hervieu, 14790 Fontaine Etoupefour; or by sending an email to reclamation@wildbed.fr. The date the cancellation is received will determine any cancellation fees. Failing this, the customer will be required to pay the sums due under the contract.
• Rental Stay: For any stay canceled more than 30 days before the arrival date, a cancellation fee of €30 is retained for each rental reserved. Between 30 days and 15 days before arrival, 50% of the amount of the stay is retained or a flat rate of €30 if the calculated amount is lower. Between 14 days and 7 days 75% of the amount of the stay is retained or a flat rate of €30 if the calculated amount is lower. Less than 7 days before the arrival date or in the event of no-show at the campsite, the total amount of the stay is due and kept.
• Stay in a campsite: For any stay canceled more than 30 days before the arrival date, a cancellation fee of €20 (or the total amount of the stay if it was less than €20), for each pitch . From 30 days before arrival, the amount of the deposit is retained. In the event of no-show at the campsite, all amounts paid are retained.
Non-consumption of additional services: The fact of not having used the services provided for during the stay cannot give rise to reimbursement. Regardless of the cancellation date chosen, processing fees and any insurance purchased are non-refundable.
STAYS / OFFERS / NON-CHANGEABLE AND NON-EXCHANGEABLE “FIRST SERVED” STAYS
WILD BED can offer stays and rentals at preferential “1ST served” rates on specific dates which are non-changeable, non-refundable, non-exchangeable. The cancellation and modification conditions previously provided for do not apply. Consequently, no reimbursement can be made, including the reimbursement of additional services which would have been reserved in addition.
DELAYED ARRIVAL, EARLY DEPARTURE In the absence of a message from the CLIENT allowing acknowledgment of receipt, specifying that they had to postpone their arrival date, the pitch or accommodation becomes available 24 hours after the arrival date provided for in the rental contract and full payment of benefits remains required. No reduction will be granted in the case of early departure for rental property (see reimbursement possibilities under the cancellation insurance). In the case of early departure during a stay on a bare pitch, we will only keep the deposit for the days not spent if the stay has been booked.
DEPOSIT For any stay in rental accommodation, a security deposit of €150 will be requested at the latest upon arrival at the campsite; this security deposit is also valid for bike rental. Payment may be requested by credit card. The latter will be returned in full on the day of departure or at the latest within eight days, after a cleaning check and the equipment is in satisfactory condition. Otherwise, the security deposit will be taken in full or up to the price of the corresponding service (cleaning for example). Damages greater than the amount paid as a security deposit will be the responsibility of the customer after deduction of the security deposit.
HOUSEHOLD The CLIENT must return their accommodation in perfect clean condition. In the majority of our establishments, you can request that the cleaning be carried out by us, for a cleaning fee (from €15 to €50: amount which may vary depending on the accommodation, the season or the destination – refer to the prices of the destination).
HOBBIES Any free or paid activity mentioned on our website, in an email or offered on site may, in certain circumstances, be modified or canceled upon your arrival on the site. MINORS Minors unaccompanied by their parents are not accepted on WILD BED campsites.
ANIMALS Pets can be accepted inside the rentals for a supplement (variable depending on the type of accommodation). Only one pet is allowed per campsite, upon payment of a fixed sum per day. The CUSTOMER must indicate this when booking or upon arrival on site. Pets cannot move freely and must be kept on a leash. They are not allowed in collective premises (sanitary facilities, snack bar, bar, restaurant, entertainment room). Their reception meets two conditions: - valid anti-rabies vaccination - identification by tattoo or chip certified by a card published by the Société Centrale Canine. The customer must bring the animal's health record and comply with the internal regulations of each site. Dangerous or aggressive animals (1st and 2nd category dogs prohibited) as well as new pets are not accepted.
INTERNAL RULES In order to facilitate the stay of all our customers, internal regulations are available at the reception of each of our sites. We thank our customers for reading it and respecting it. In the event of blatant non-compliance with these regulations, the campsite Director may take sanctions which may include termination of the contract and require the customer to leave early without compensation.
LOSS, THEFT, DAMAGE WILD BED declines all responsibility in the event of theft and damage to personal objects in accommodation, on campsites as well as in common premises. WILD BED cannot be held responsible in the event of theft or damage to customers' personal items except in the event of proven failure by the campsite to fulfill its contractual obligations. Please also note that the car parks are not guarded and that parking is therefore at the customer's own risk. WILD BED also declines all responsibility in the event of an incident falling under the civil liability of the CUSTOMER.
PERSONAL DATA Customers' personal data are collected and processed by WILD BED SASU. Certain data is essential to manage the reservation of the CLIENT's stay and will also be used to send them information and/or promotional offers. In accordance with article 40 of law n° 78-17 of January 6, 1978 known as the “Informatique et Libertés” law, the CUSTOMER has the right to access, modify, rectify and delete personal data concerning you. FORCE MAJEURE Any circumstances beyond the control of the parties preventing the execution under normal conditions of their obligations are considered as causes of exemption from the obligations of the parties and result in their suspension. The party invoking the circumstances referred to above must immediately notify the other party of their occurrence, as well as of their disappearance. All irresistible facts or circumstances, external to the parties, unforeseeable, inevitable, independent of the will of the parties and which cannot be prevented by the latter, despite all reasonably possible efforts, will be considered as force majeure. Expressly, are considered as cases of force majeure or fortuitous events, in addition to those usually retained by the jurisprudence of French courts and tribunals: storms, floods, lightning, earthquakes, fires, shutdown of telecommunications networks or difficulties specific to telecommunications networks external to customers, blocking of means of transport or supplies. The parties will come together to examine the impact of the event and agree on the conditions under which the execution of the contract will be continued. If the force majeure lasts for more than three weeks, the pitch rental and accommodation contracts will be terminated automatically.
PARTIAL NON-VALIDATION If one or more stipulations of these general conditions are held to be invalid or declared such in application of a law, a regulation or following a final decision of a competent court, the other stipulations will retain all their force. and their scope.
NON WAIVER The fact that one of the parties does not take advantage of a breach by the other party of any of the obligations referred to in these general conditions cannot be interpreted for the future as a waiver of the obligation. in question.
CONTRACT LANGUAGE These general conditions of sale are written in French. In the event that they are translated into one or more foreign languages, only the French text will be authentic in the event of a dispute.
MEDIATION In the event of a dispute arising regarding the validity, interpretation, execution or non-execution, modification or termination of the contract, the CUSTOMER and WILD BED will endeavor to find an amicable solution. To this end, the customer will send his complaint by registered mail with acknowledgment of receipt to WILD BED SASU 1 rue aux Hervieu 14790 Fontaine Etoupefour, France or to the following address: reclamation@wildbed.fr within one month following the stay. In the absence of a response deemed satisfactory, by the customer or by WILD BED, to a complaint formulated under the conditions mentioned above, the most diligent party will submit the dispute to SAS MEDIATION, mediation organization. For the customer's complete information, they are informed that recourse to SAS MEDIATION is a free procedure for them, even if they initiate the referral. APPLICABLE LAW These general conditions are subject to the application of French law. This is the case for substantive rules as well as for formal rules. In the event of a dispute or complaint, the customer will contact WILD BED as a priority to obtain an amicable solution.
