General Terms and Conditions of Sale for Camping Au Bord de Loire

ARTICLE 1: PURPOSE AND SCOPE OF APPLICATION
These general terms and conditions of sale apply automatically, without restriction or reservation, to any purchase of accommodation rental services, bare pitches, or any other service offered by Camping Au Bord de Loire to consumers and non-professional Customers, hereinafter referred to as the Customer.
The main characteristics of the Services are presented on the website www.camping-auborddeloire.com or in written form (paper or electronic) in the event of a reservation by a means other than a remote order.
The Customer is required to read them before placing an order. The selection and purchase of a Service is the sole responsibility of the Customer. These Terms and Conditions apply to the exclusion of all other terms and conditions of Camping Au Bord de Loire, and in particular those applicable to other marketing channels for the Services. These General Terms and Conditions are accessible at any time on the website and will prevail, where applicable, over any other version or any other contractual document. The version applicable to the Customer is the one in force on the website or communicated by Camping Au Bord de Loire on the date the Order is placed by the Customer. Unless proven otherwise, the data recorded in the Camping Au Bord de Loire computer system constitutes proof of all transactions concluded with the Customer. Under the conditions defined by the Data Protection Act and the European Data Protection Regulation, the Customer has, at any time, a right of access, rectification, and opposition if the processing is not essential to the execution of the order and the stay as well as their consequences, to all of his personal data by writing, by mail and providing proof of identity, to Camping Au Bord de Loire, 1 place du 19 mars, 49350 GENNES. The Customer declares that they have read and accepted these General Terms and Conditions of Sale and the internal regulations.
ARTICLE 2: BOOKING CONDITIONS
Reservations are strictly personal and may not be transferred, assigned, or sublet under any circumstances, under penalty of nullity.
Minors must be accompanied by their parents or legal guardians.
Camping Au Bord de Loire reserves the right to refuse a Customer if they have previously caused damage, violated safety rules, or disrupted the peaceful enjoyment of other Customers.
2.1 Quote/Option
Booking online, by email, or by telephone requires the establishment of a prior reservation option. Sending this reservation option does not constitute final confirmation of the reservation.
2.2 Reservation
The reservation only becomes effective after payment of a deposit equal to 30% of the total cost of the stay or after payment of the full price of the stay (if the option was set less than 30 days before arrival). This reservation is only legally binding upon receipt of a booking confirmation issued by Camping Au Bord de Loire.
2.3 Payment of the Balance
If the reservation resulted in a deposit being paid by the Customer, the balance of the stay is payable in full one month before the arrival date. Failure to pay the balance, after a reminder by any means from Camping Au Bord de Loire, will automatically result in cancellation of the reservation and application of the Cancellation section.
2.4 Cancellation at the Customer's initiative
2.4.1 With cancellation insurance
When making a reservation, the Customer may purchase optional Cancellation/Interruption insurance provided by the Campsite. The general terms and conditions of Cancellation/Interruption Insurance are available upon request from Camping Au Bord de Loire or from the insurer Meetch. In addition to notifying the insurer, the Customer must notify Camping Au Bord de Loire by any means (email, telephone, etc.) as soon as the event preventing or interrupting the stay occurs.
The reimbursement conditions will then be those of the insurer. Camping Au Bord de Loire cannot be held responsible for reimbursements. 2.4.2 Without cancellation insurance
In the event of cancellation of the reservation by the Customer after its acceptance by Camping Au Bord de Loire, for any reason whatsoever, the conditions are as follows:
Cancellation more than 30 days before the stay: the deposit will be automatically retained by Camping Au Bord de Loire and will not be refunded (if the Customer has not paid a deposit, they will be liable for cancellation fees amounting to 30% of the cost of the stay).
Cancellation less than 30 days before the start of the stay: the entire cost of the stay will be automatically retained by Camping Au Bord de Loire and will not be refunded.
(If the Customer has not paid the full amount of the stay by this date, they will be liable for cancellation fees equal to the total amount of the stay).
In all cases, the Customer must notify Camping Au Bord de Loire by mail or email of the cancellation of the stay; only the date of receipt will be considered valid.
2.5 Reservation Changes
No reduction or refund will be made in the event of no-show, late arrival, early departure, or if all or some of the occupants are absent for one or more nights during their stay.
In the event of a no-show by the Customer within 24 hours of the start of the stay and without providing proof and/or notification of the Customer's arrival, Camping Au Bord de Loire will retain the pitch or rental accommodation. ARTICLE 3: STAY PROCEDURE
3.1 Hours
Accommodation rentals begin at 3:00 p.m. and end at 10:00 a.m.
Pitch rentals begin at 2:00 p.m. and end at 12:00 p.m.
Reception is open until 7:00 p.m. in July and August, and until 6:00 p.m. in other months.
3.2 Late Arrival
In the event of late arrival (outside reception opening hours), the Guest must notify Camping Au Bord de Loire, which will explain the check-in procedures.
This delay will not result in any refund.
3.3 Early Departure
Any vacating and, where applicable, returning the key to the rented accommodation or vacating the pitch after the times specified in the Times section will result in the invoicing of an additional night. No discount will be applied for early departure. 3.4 Pets
Pets are allowed (limited to 1 pet per accommodation or 2 pets per pitch) with a supplement per pet per day, provided they are vaccinated and kept on a leash by an adult. Pets are not allowed in the playground, and the Customer must ensure that Camping Au Bord de Loire is clean when their pet is using their natural needs.
The Customer must be able to present the required vaccination certificates.
Camping Au Bord de Loire may refuse any pet owner who does not comply with this clause.
Category 1 or 2 pets are not allowed.
3.5 Change of Pitch or Accommodation
The Campsite may assign accommodation or a pitch different but equivalent to the one originally reserved in cases where a clear need is established. 3.6 Security Deposit
For accommodation rentals, the Guest must pay a €100 security deposit upon arrival for equipment and a €50 cleaning deposit. These deposits cover loss, breakage, and damage to equipment and the exterior, as well as the impeccable cleanliness of the rental.
An inventory will be carried out upon the Guest's arrival and departure. Any complaints regarding the condition of the accommodation or its inventory must be brought to the attention of Management no later than two hours after arrival. After this period, no complaints will be considered: the tenant will therefore be held responsible for any missing items or damage noted.
The security deposit will be returned to the Guest at the end of the stay or no later than seven days after its end, less any compensation retained for any damage noted in the exit inventory. The withholding of the deposit does not preclude additional compensation in the event that the costs exceed the deposit amount.
3.7 Internal Regulations
Every person present on the campsite must read and comply with the safety instructions and internal regulations. Failure to comply may result in permanent exclusion without refund or compensation.
The internal regulations are available at the entrance and reception of Camping Au Bord de Loire.
3.8 Visitors
The Customer is required to inform the Campsite Management of any visitors who may come to visit. Visitors must report to the reception desk upon arrival and provide the identity of each person.
ARTICLE 4: RATES
For unfurnished pitches, the rates include the use of the rented pitch as well as free access to the campsite's restrooms. For accommodations, unless otherwise stated, the rates include water, electricity, and gas under normal usage conditions, as well as the use of the accommodation rented in accordance with the quote, with all amenities specific to that accommodation.
The price of services is indicated in euros, including VAT. The Customer's attention is drawn to the fact that tourist tax is not included in the price.
These rates are fixed and not subject to revision during the validity period, which extends from the start of reservations until the annual closing of Camping Au Bord de Loire.
Camping Au Bord de Loire reserves the right to modify prices at any time outside this validity period. The provision of optional services, such as (this list is not exhaustive) equipment rental, bed and bath linens, and catering, will incur an additional charge based on the current rates displayed at reception.
ARTICLE 5: PAYMENT TERMS
Payment for services is made by bank transfer, check, ANCV Classic or Connect holiday vouchers, credit or debit card, cash, or via a credit card payment platform chosen by Camping Au Bord de Loire.
ARTICLE 6: RIGHT OF WITHDRAWAL
According to Article L221-28 of the French Consumer Code, given the nature of the services provided, the customer does not have a right of withdrawal. The contract is definitively concluded upon acceptance of the quote by the CLIENT in accordance with the terms and conditions specified in Article 2.
ARTICLE 7: COMPLAINTS
Complaints regarding the stay must be brought to the attention of the management of Camping Au Bord de Loire as soon as possible. The management will endeavor to find a solution quickly.
ARTICLE 8: NATURAL RISKS
Camping Au Bord de Loire is located within the scope of the rising waters of the Loire River.
In the event of an alert of any kind, the management will take all necessary measures to keep the Client informed, through on-site visits, messages at reception, and possibly telephone calls.
For rentals completed during this alert period, deposits or invoices paid will be partially or fully refunded depending on the number of rental days not completed. ARTICLE 9: APPLICABLE LAW
These General Terms and Conditions of Sale and the transactions resulting therefrom are governed by and subject to French law. In cases where they are translated into one or more foreign languages, only the French text shall prevail in the event of a dispute.
ARTICLE 10: DISPUTES
10.1 Competent Court
All disputes arising from sales transactions concluded pursuant to these General Terms and Conditions of Sale, concerning their validity, interpretation, execution, termination, consequences, and follow-up, and which cannot be resolved between Camping Au Bord de Loire and the Customer, shall be submitted to the courts of Saumur (Maine-et-Loire), the place where the service was provided. 10.2 Consumer Mediation
The Customer is informed that, after submitting a written complaint without resolution, they may seek conventional mediation, in particular with Medicys, for disputes arising from the sale or provision of services between the Customer and Camping Au Bord de Loire. Consumer mediation is free of charge, and the associated costs are borne by Camping Au Bord de Loire.
